Is Marijuana Legal In Portland, Oregon?

Here’s the big question we get asked all of the time:

Is marijuana now legal in Portland?

No.

Only people who have a medical marijuana card can purchase and possess marijuana (see our FAQ for how to obtain a card). Legal recreational marijuana possession will not take effect until July 1, 2015. Until then, possession of 1 to 4 ounces is considered a misdemeanor and possessing more is a felony. Possession of less than an ounce remains a non-criminal violation through July 1, 2015.

Will it be legal in July?

Yes, to possess…. but, not to purchase.
People 21 and older will be allowed to possess up to 1 ounce of marijuana in a public place and up to 8 ounces in their home. You can also have up to four marijuana plants per household.

Where can I smoke it?

In your home or another private place. Walking around with a joint, or even sitting on your front steps with a lit blunt will not be legal. Please don’t try.

When will it be legal to purchase marijuana?

At some point in 2016, marijuana will be available for purchase by the general over 21 crowd through retail stores.  Measure 91 requires the OLCC to begin accepting retail license applications by January 4, 2016. There are still a lot of details being worked out by the Oregon Liquor Control Commission which is tasked to refine the details of the law.
